NEWS UPDATE

The application to proceed towards a Judicial Review of the Planning Committee Decision on the Castle Green Development on the Bellis Fields on the 7th February 2022 was heard on last Friday, 29th July 2022, at the High Court sitting in Wrexham Law Court.

We regret to inform you that our request for permission to bring a Judicial Review was refused by the High Court Judge following several hours of detailed case argument by our Barrister.

We are very disappointed that this was refused but the nature and implications arising from the Judge’s Decision cause us great concern.

As a result of the decision we are considering our option to take the matter to the Court of Appeal and will be working on this aspect with our Legal and Planning Team over the next few days.

Appeal timescales are tight so we have only until Friday 5th August to lodge the application papers with the Court of Appeal. We will provide a further update on our course of action during next week, which will allow us a few days to gather our thoughts on the Appeal. Our legal team have already started working on it and they too were extremely disappointed and concerned.

Just to recap we may have lost the latest battle but we intend to continue the fight in the war to ensure that the village is properly heard on the problems being faced by everyone in the event the imposed conditions on the development are not being strictly observed.

We consider that the Decision handed down to us has huge implications for everyone, not just here in Rossett and should be considered by Judges in an even Higher Court.
