Weʼve raised £20 to Help fund legal fight, the malicious prosecution by Tri Borough Council in their attempts to criminalise Elective Home Educator

    Story

I am mum of three gifted-disabled, young carers and entrepreneurs, from Chelsea who won on appeal at Old Bailey, CCC 16/07/2015. The appeal panel, headed by Honourable Judge Richard Hone QC, quashed the earlier criminal conviction and IMPRISONABLE offence for not complying with School Attendance Order and fine of £1,020, thanks to pro bono expert witness statement by Dr Alan Thomas, MSc., PhD., FBPsS, UCL Institute of Education.
As a claimant I have suffered damages (losing a job, flat, our health suffered) as a result of prosecution which was terminated in my favour.
The reasonable & probable cause for bringing the prosecution were absent, which was brought maliciously. (Graham Stuart MP, raised concerns about apparent misrepresentations of the law. Letter to Elizabeth Spearman dated 8 May 2014 Tri Borough “misstates the powers and responsibilities of local authorities in this regard” ultra vires policy.)

I find it staggering that the council would seek to impose inspections without a legal grounds, based solely on prejudice, discrimination and revenue, such a draconian law is a direct attack on democracy and rights to do what is best for each individual child and what is lawful.
I WANT to fight this, for my children and over 27,000 EHE. Appeal cost me over £3000 and I was NOT awarded my costs in respect of that part of the fight. All press and media was in the public interest.
My costs dealing with this latest attempt to get access to law and justice by asking for the permission to bring malicious prosecution case could well exceed £3000 in barristers fees. Unless I can get the support from the law abiding fellow Brits, there is a very real possibility that I will have to 'withdraw from the fight' and potentially let council's ultra vires policy win because the 'costs risks' are now more than one private individual can afford.
A HUGE thank you to everyone for your continued support and encouragement, whether you are able to donate to this fight or not.
