Hi, my name is Uma and I looking for sponsor(s) to support my representation to Employment Tribunal for unfair dismissal on the grounds of Incapability. I worked for an unscrupulous Bank (no names mentioned) who ran a disciplinary suspension for gross misconduct for expenses issues to a work event applying a misconduct on file (I had health issues at the time no Occupational Health procedure and the Bank convened and ran a formal Bank hearing process for charges without the required OH procedure (pre requisite.))
When I complained to the Employment Tribunal at the time the first time, the complaint itself and procedures the Bank were supposed to follow were ignored and the Tribunal mislead. From the reply to the complaint the Bank were already leading in their reply to the OH (use,) there was no need. They were asked to take the misconduct of file by the ER manager in the City and they said "this would create a precedence," unknown to anyone before they acquired OH consent leading to a PCA (disposal process - Psychological Capability Process which managers can get and apply,) in order to refrain from admitted procedural errors. They did not want to admit to other procedures were not followed for formal Bank hearing process.at the time and I could have still remained employed.
I am pleased to say we are at a good stage from the evidence of this but I would need representation and help with fees as my per year net income is 6600 pounds because of these circumstances.
