Our children can't attend the same school becuase of how the local authority have structured the over subscription criteria. The impact that this will have on our family considering our childs disabilities is something we feel strongly is wrong.
Having undertaken considerable reasearch into the rules that underpin school admissions in the UK, we put the matters of law before the authority. Admissions authorities have a duty to make reasonable adjustments under the Disability Discrimination Act. Also, We advised that the authority had broken the SACode at page 34, para 172 published by DCSF (Can be viewed here) http://www.dcsf.gov.uk/sacode/downloads/SchoolAdmissionsCodeWEB060309.pdfFaced with our evidence, the 'independent' appeals panel selected by the local authority still didn't uphold our appeal. We are sure that we are not the first family, and certainly wont be the last that are disadvantaged in this way. Families who are already facing disproportionately challenging lives are being disadvantaged and we would like to stand up for the rights of this group in our borough and insist on necessary change. To correct this error we need to take legal action.
